These Terms and Conditions govern the use of this website and the purchase of original paintings, limited-edition prints and related products available through David E Thomas Art.
By accessing this website or placing an order, you agree to these Terms and Conditions. If you do not agree, please do not use this website.
PURCHASING ARTWORK
Every effort is made to ensure product descriptions, pricing and availability are accurate at the time of publication.
Orders are subject to acceptance and availability. If an artwork becomes unavailable after an order has been placed, you will be contacted promptly and offered an appropriate solution, including a full refund where applicable.
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
ORIGINAL PAINTINGS
Every original painting by David Emerson Thomas is a unique, hand-painted artwork.
Once sold, an original painting is no longer available for purchase.
Where applicable, a limited-edition print may later be released from an original artwork. The availability of prints does not affect the originality or authenticity of the original painting.
LIMITED-EDITION PRINTS
Each limited-edition print is produced in Australia as part of a strictly limited edition, the size of which is clearly stated on the individual product page.
Unless otherwise specified, paper and canvas versions share the same edition.
Each print is individually signed and numbered and is supplied with a signed and numbered Certificate of Authenticity corresponding to the edition number.
SHIPPING
Orders are professionally prepared and packaged to help ensure they arrive safely.
Estimated production and dispatch timeframes are outlined on the Shipping Information page. While every effort is made to meet these estimates, delivery times may vary depending on the destination and carrier.
We welcome enquiries from international collectors. International customers must contact us before purchasing so we can confirm the delivery address, presentation format, shipping cost, customs requirements and insurance.
RETURNS AND REFUNDS
Returns and refunds are handled in accordance with our Returns and Refunds Policy and Australian Consumer Law.
If your artwork arrives damaged, faulty or incorrect, please contact us as soon as possible so we can assist.

COPYRIGHT AND INTELLECTUAL PROPERTY
All artwork, images, text and content on this website remain the intellectual property of David Emerson Thomas unless otherwise stated.
No artwork, photographs or website content may be reproduced, copied, distributed or used for commercial purposes without prior written permission.
The purchase of an artwork does not transfer copyright.
COLOURS AND WEBSITE ACCURACY
Every reasonable effort is made to accurately represent the colour, detail and appearance of each artwork.
However, colours and tonal appearance may vary slightly between screens because of differences in display settings, brightness and calibration.
Colours, tonal appearance and surface character may also vary slightly between the original artwork, paper prints and canvas prints due to the different materials and reproduction processes used.
Minor screen-to-screen or material-related variation does not necessarily mean that an artwork is faulty or materially different from its description.
CHANGES TO THESE TERMS
These Terms and Conditions may be updated from time to time without prior notice.
The version published on this website at the time of purchase will apply to your order.
